"Marketable" versus "Non-Marketable" Real Estate for Sale...

Well, there are certainly some interesting San Diego real estate statistics when it comes to “homes for sale”, foreclosures, and short sales.

For many buyers entering the market it can be confusing to say the least, and at times overwhelming when trying to sift through dozens or hundreds of competing properties. One distinction that needs to be addressed is “marketable” versus “non-marketable” property. Unfortunately, the market is currently flooded with non-marketable real estate.

This would include many properties that are marketed as a “short sale”. In many cases the property has yet to be negotiated by the trustee (or bank). It is merely a “desire to sell” by a owner and agent, at a price below what is owed to the bank.

So here in lies the dilemma: A real estate agent will list a property for sale in the MLS, and disclose to the world that the transaction will be a "short sale". The flaw however is that in far too many cases, the "short sale" has yet to be negotiated between the seller and the bank. It could merely be a "pipe dream" of the seller, agent, or both. The reality of the market is that most banks are overwhelmed with actual and pending foreclosures, and as such do not have the resources to negotiate the "possibility" of a future foreclosure.

So be sure to have your agent do the due diligence prior to writing an offer to avoid getting bound-up into a legally binding contract. There are many cases of buyers being strung along for many months while a seller and listing agent attempt to "negotiate" with the bank, to no avail.

In contrast, a “marketable“ property is one in which the seller or bank is ready willing and able. They have either pre-negociated a "willingness" to sell the property at a price below the outstanding balance. If the property is already foreclosed and owned by the bank then the motivation is high to sell the property and remove it form "the books".
